OFFER AND ACCEPTANCE :
This contract constitutes an offer to the client expressly limited to the terms herein. Acceptance shall be effective upon the client’s signature to this contract. Any terms and conditions set forth in any written acknowledgment or correspondence sent to the client that modify, add, or delete terms and conditions of the order are hereby expressively rejected by “NX Hotel - Kolkata” and shall have no force or effect unless expressly stated in the contract. - TERMS APPLICABLE TO SERVICES :
Unless otherwise agreed by “NX Hotel - Kolkata” the services must finish at the time specified in the contract. The client is liable to pay additional charges as per the agreement beyond the times specified in the contract. Services must be conducted in an orderly and lawful manner. “NX Hotel - Kolkata” reserves the right to conclude the service if it is reasonably believed that it is not being conducted in an orderly and lawful manner. Loud music, service of alcohol, and other types of entertainment will only be permitted till 22:00hrs. - Difference between Guaranteed and Expected PAX Should not be more than 10 %, if it creases then the number should inform one-day prior notice. “NX Hotel - Kolkata” will not procure necessary statutory permissions and licenses that may be involved for the services like fashion shows, and so on until and unless stated. Smoking is not allowed in banquet or public areas. “NX Hotel - Kolkata” warrants that all services provided hereunder (1) will be performed in a professional and workmanlike manner, and (2) will be performed in accordance with the terms, conditions, scope, specifications, schedules, and time and place of performance specified in the contract and/or any separate statement of work or agreement regarding such services. Any services not mentioned in the contract would be charged separately as per the printed rates. OWNERSHIP: Guest is liable for all loss or damage to Hotel property by the client’s participants; “NX Hotel - Kolkata” does not take the liability of any theft, damage, or loss of any goods, equipment brought by the client into the resort; or any introduction of the food to the event and the effect of it afterward. Safety deposit boxes are available at the front desk if the personal property needs to be secured. Upon request, the client must provide evidence of appropriate liability insurance. Any damage to the premises will be charged accordingly.
- PRICES, TAXES AND PAYMENT :
The prices specified on the contract shall remain fixed for all scheduled products and services unless otherwise agreed in writing by both parties. “NX Hotel - Kolkata” represents that the prices for the products or services are at least as favorable as the prices currently paid by any other customer of the supplier, buying the same or similar products or services in equal or smaller quantities under similar terms and conditions. As required by the state law statutory taxes applicable to all products and services will be levied. Until and unless the credit is pre-approved, “NX Hotel - Kolkata” shall receive payment at the time of check out. - ADVANCE DEPOSIT :
A deposit, equal to 50% of the estimated invoice must be paid in advance for confirming the reservation. An advance paid cannot be refunded, however, the same can be used within a period of 6 months from the date of deposit for any future endeavor. - KIDS POLICY :
Kids under 6 years are provided complimentary services, kids from 6-10 years will be charged 50% of the adult charge, and kids above 10 years will be charged adult fare/price. - CANCELLATION OR REDUCTION :
Client may, by written notice, cancel the order, in whole or in part, in accordance with the delivery date or schedule, which is 15 days prior to the services or if the client fails to comply. If the cancellation of guaranteed reservations is not received by the required date, the advance payment will be nonrefundable and an additional cancellation charge would be levied. - DOCUMENTS :
As per the law and directive from Indian income tax authorities, for any transaction more than INR 25,000 a photocopy of the PAN card is required of the client. - JURISDICTION :
All jurisdictions in the court of law shall be at Kolkata, India. - GENERAL :
If any terms or conditions of the contract shall be found to illegal or unenforceable, such term or provision shall be deemed stricken and all other terms and conditions shall remain in full force and effect. The contract and any referenced attachments here constitute the entire understanding between “NX Hotel - Kolkata” and Clients with respect to the services and supersedes all prior oral and written communications. The contract may be amended or modified only in writing signed by authorized representatives of both parties. This contract shall be governed by and construed in accordance with the laws of India without regard to the conflict of law’s provisions thereof. The courts in Kolkata. - We accept confirmation of the above offer by return confirmation letter along with the signed Function Prospectus (FP) from your end
- Non –arrival of the guest amounts to a no-show. Reservation must be canceled 48 hrs prior to the planned date of arrival. One night room charge will be levied in case of cancellation made within 48 hrs or in case of a No- Show.
